Another rule of evidence, particularly applicable to criminal cases, does not allow

This rule is imposed to
protect a defendant of bad character from the prejudice of a jury learning of a
previous conviction. If such evidence were allowed it would tend to relieve the
prosecution of its duty to prove the guilt of the defendant in respect of the specific
charge for which he is on trial. For the same reason, the failure of the defendant to
give evidence in his own defence should not be regarded as an indication that he is
guilty.
Prosecution may not normally refer to any statement by the defendant
confessing his guilt, unless it is abundantly clear that, when it was made, the
defendant fully appreciated the possibility of its subsequent use in evidence
The jury must always remain impartial and keep an open mind until the
conclusion of the case. When the evidence has been concluded, the jury will be
directed on the matters which they have to take into consideration, before they
arrive at their decision. The punishment which follows the verdict is a matter for
the judge. The jury, however, have the right to make a recommendation to mercy
if they so desire.
