 Que, mediante el presente escrito, interpongo DEMANDA DE RECLAMACIÓN DE CANTIDAD frente a Dña. Lupe Amondarain, con domicilio en Anoeta, con base en los siguientes hechos y fundamentos de derecho: 
 HECHOS 
 Primero. Que el demandado me debe una cantidad de dinero que no recuerdo exactamente. 
 Segundo. Que el demandado no ha querido pagarme pese a que yo he hecho múltiples intentos de cobrar lo adeudado.

4.- El demandado alega prescripción en la CD, ¿se ventilará la cuestión en la Audiencia Previa o tendremos que ir al juicio oral para sanear?
De acuerdo con el art. 414.1 párr 3º LEC “La audiencia se llevará a cabo, conforme a lo establecido en los artículos siguientes, para examinar las cuestiones procesales que pudieran obstar a la prosecución de éste y a su terminación mediante sentencia sobre su objeto, fijar con precisión dicho objeto y los extremos, de hecho o de derecho, sobre los que exista controversia entre las partes y, en su caso, proponer y admitir la prueba.”
Entonces no deberá alegarla en el juicio oral en caso de que se ventile en la audiencia previa.
  
5.- Día 14 del plazo para contestar la demanda, no hemos solicitado la declinatoria en los primeros 10 días. Sin embargo, en la CD alegamos falta de jurisdicción y competencia. El actor dice que estamos fuera de plazo para hacerlo. El juez también da constancia que estamos fuera de plazo, pero es evidente que no es competente. 
¿Qué sucederá? (hay preclusión, ya no se puede y no lo ha hecho en tiempo)
 
Sucederá la sumisión tácita por parte del demandado de acuerdo con el art. 56.2º LEC, “El demandado, por el hecho de hacer, después de personado en el juicio tras la interposición de la demanda, cualquier gestión que no sea la de proponer en forma la declinatoria. También se considerará tácitamente sometido al demandado que, emplazado o citado en forma, no comparezca en juicio o lo haga cuando haya precluido la facultad de proponer la declinatoria.” 

6.- Hemos celebrado un convenio arbitral entre las partes, obligándonos a someter a arbitraje las controversias que surjan o puedan surgir respecto a esa concreta relación jurídica, pero resulta que la otra parte ha incoado un proceso ordinario contra nosotros. ¿Qué podemos alegar? ¿En base a qué normas? ¿En qué momento? ¿Qué efecto tendrá nuestra alegación? 

La norma aplicable es la ley 60/2003 de arbitraje y su art. 11 dice que “lo estipulado en el convenio arbitral impide a los tribunales conocer de las controversias sometidas a arbitraje, siempre que la parte a quien interese lo invoque mediante declinatoria”
Podremos contestar a la demanda e interponer la declinatoria (Art. 63 LEC) por la cual se podrá denunciar la falta de jurisdicción del tribunal ante el que se ha interpuesto la demanda, por corresponder el conocimiento de esta a árbitros o mediadores.

7.- Hemos interpuesto una demanda para anular la inscripción en el Registro de Tolosa de la inmatriculación de una finca, es lo único que solicitamos en el suplico. 
En la Audiencia previa aclaramos que también solicitamos la nulidad del título que el demandado ha utilizado para realizar la citada inscripción registral (fijar el objeto del pleito). ¿Estaremos en el marco de aclaraciones y se nos validará nuestra posición?
